These Terms and Conditions ("Terms") govern your access to and use of our platform, services, and content, including the GATHA mobile application and website (collectively referred to as the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. Please read them carefully.

GATHA is a digital platform designed to connect users, venues, and brands through diverse, inclusive events, with a focus on supporting the LGBTQ+ community and allies.

Our mission is to create a safe and vibrant space for everyone to find and participate in events that align with their interests and values.

To use GATHA, you must:

• Be at least 18 years old.

• Have the legal capacity to enter into a binding agreement.

• Provide accurate and complete registration information

By using the Platform, you represent and warrant that you meet these eligibility requirements.

GATHA reserves the right to refuse service, close accounts, or restrict access to the Platform if you do not comply with these Terms.

To access certain features of GATHA, such as RSVP to events, create or promote events, or engage with other users, you may need to create an account.

You agree to:

• Provide accurate and complete information during registration.

• Keep your account information updated.

• Safeguard your account login credentials and notify GATHA immediately of any unauthorised access or breach of security.

• Be responsible for all activity that occurs under your account.

GATHA is not liable for any loss or damage arising from unauthorised use of your account.

When using GATHA, you agree to:

• Respect others: Treat all users, venues, and partners with respect. GATHA promotes inclusivity and does not tolerate discrimination, harassment, or abusive behaviour.

• Comply with laws: Use the Platform in accordance with all applicable laws and regulations, including those governing privacy, data protection, and event participation.

• Event conduct: Follow the guidelines, rules, and terms set by event organizers and venues when attending or participating in events.

• Content sharing: You may share content (e.g., reviews, photos), but you must ensure that the content is accurate, lawful, and does not infringe on the rights of others.

You may not:

• Post or share content that is unlawful, defamatory, discriminatory, harmful, or otherwise objectionable.

• Use the Platform for any illegal or unauthorized purpose, including the promotion of violent or harmful activities.

• Access, interfere with, or use non-public areas of the Platform, or attempt to probe, scan, or test the vulnerability of any system or network associated with GATHA.

When using GATHA to discover, RSVP, or host events, you agree to the following terms:​

For Users:

​

• RSVP and Attendance: If you RSVP to an event, you agree to comply with the terms set by the event organizer or venue, including any age restrictions, ticket purchases, or dress codes.

• Cancellation: If you are unable to attend an event, you should update your RSVP status in a timely manner to allow others to attend.

• Conduct at Events: You agree to behave respectfully and responsibly at events, following the instructions of event organizers and venue staff. Any misconduct or violation of venue policies may result in your removal from the event and/or suspension from the Platform.

For Venues and Event Organiser's:

​

• Event Listing: You are responsible for providing accurate details about your event, including event type, time, venue, and any entry requirements.

• Compliance: You agree to ensure that your event complies with local laws and regulations, including health and safety guidelines, venue licensing, and COVID-19 restrictions (if applicable).

• Liability: You acknowledge that GATHA is not responsible for the conduct of attendees or the outcome of your event. All risks associated with hosting events are your sole responsibility.

GATHA may offer paid services, such as event promotion packages or venue memberships. Payments made through the Platform are subject to the following terms:

• Payment Information: You agree to provide valid and accurate payment information when purchasing services or event tickets.

• Refunds: All sales are final unless otherwise specified in the event description. Refunds for events or services are subject to the terms set by the event organizer or venue.

• Service Fees: GATHA may charge a service fee for paid events or promotional services. These fees will be clearly outlined at the time of purchase and are non-refundable.

GATHA and its content (including text, graphics, logos, and software) are the property of GATHA or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or sell any content from the Platform without prior written consent from GATHA

• Use any of GATHA’s trademarks without our express permission.

GATHA reserves the right to suspend or terminate your account if you violate these Terms or engage in behaviour that negatively impacts other users, event organizers, or venues.

We may also suspend or terminate access to the Platform without prior notice for business reasons.

We reserve all rights to terminate or suspend accounts for business reasons.

To the fullest extent permitted by law:

​

• GATHA and its affiliates, officers, employees, or partners will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Platform, attendance at events, or engagement with other users.

• GATHA does not guarantee the accuracy or reliability of any content posted by users or event organisers and is not responsible for user conduct at events.

• Service Availability: GATHA makes no guarantees that the Platform will be available at all times, error-free, or secure.

• Event Responsibility: GATHA acts as a facilitator for connecting users with events and venues. We are not responsible for the content, conduct, or quality of events hosted by third parties.

​

User-Generated Content: GATHA is not responsible for user-generated content and does not endorse any opinions expressed by users on the Platform.

• You agree to indemnify and hold harmless GATHA, its affiliates, and partners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or conduct at events.

• These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

• You agree to submit to the exclusive jurisdiction of the courts located in all states and territories to resolve any legal matter arising from these Terms or your use of GATHA.

• GATHA reserves the right to modify or update these Terms at any time. When we make significant changes, we will notify you by posting the updated Terms on our website and updating the "Effective Date" at the top of this page. Your continued use of GATHA after the changes take effect constitutes your acceptance of the new Terms.
